John, I think this is exactly the amount of development the comic needs.

Bought a house with an underground (most of the time) river. Learned that redirecting it made me liable for any damage done by the resulting flow. Only option was to bury pipes to take it to the storm drains. Cannot imagine having to pay for the Mississippi’s damages.

I suspect that the ruling had nothing to do with "originality." More likley is that no copyright was filed or even available in the EU or Luxembourg. Perhaps Zhang did not own the copyright (perhaps it is owned by Harper's) and therefore did not have standing to bring the suit.
If the goals were to embarrass the "fine artist" and Bring Zhang publicity, then he has won.

With our new laws, people have been getting out of the store even faster than self-checkout. It is called non-checkout. They just leave without paying. Any theft less than $1,000 will not be prosecuted.
