Fat Guy Sues White Castle Burger Over Small Booths

Alex

Love White Castle burgers but hate their too-teeny-tiny booths? What's a steamed steamed-burger fan to do? (See what I did there?)

Here's what one self-described "not humongous but a big guy" White Castle fan did: he sued 'em under the Americans with Disabilities Act!

A devoted, 290-pound White Castle fan is steaming mad at the fast-food chain, which he says repeatedly broke promises to make the booths in his local eatery bigger.

All stockbroker Martin Kessman wants is a place at the table. But when the 64-year-old walked into the White Castle in Nanuet back in April 2009 for his usual No. 2 combo meal, he got an unpleasant surprise.

“They’re stationary booths,” he told The Post. “I’m not humongous, [but] I’m a big guy. I could not wedge myself in.”

Mortified and in pain from smacking his knee into one of the table’s metal supports, Kessman limped out of the restaurant, and later penned a complaint to corporate headquarters.

And how did White Castle respond?

White Castle replied with three “very condescending letters” -- and an offer that added insult to injury.

“In each letter was a coupon for three free hamburgers -- but the cheese was extra!” according to a lawsuit Kessman filed last week in Manhattan federal court.

Cheese was extra? That alone is worth a lawsuit! Link (yes, with photo of the guy)

Pathetic! Why should the world adapt to the fat, slobbish and unhealthy? Right, because they're taking over and becoming the majority. FAT world USA.

If you're too fat to eat fast food, you are too fat, period. And yes, I think these people SHOULD have to pay for extra seats on airplanes because nobody wants to spend a six hour flight engulfed in your hot sweaty blubber. In the past, fatness was more forgiven due to perceived "glandular" problems, etc. The fact is people are fat because they eat too much. This dude needs to eat less sliders and maybe his "disability" will go away. You are not disabled, you are a lard bucket!

PS- I'm pretty tubby too, but I'm not suing anybody over something that was entirely my own fault.

Actually, I think he's got the right idea, and not because of his weight. A 3rd trimester pregnant woman would be unable to fit in those booths as well as someone who had a cast. Makes me wonder what their wheelchair friendly seating is like?

64 years old and 290 pounds, all White Castle has to do is wait (or is that weight) a few years and Darwin will remove the complainer for them.

Of course if he get bigger then 290, it will happen even quicker - so I don't think White Castle is thinking it thru when they're holding back on the free cheese.

Somebody needs to tell fatso that 290lbs isn't "big" it is HUMONGOUS. Perhaps what he meant is that he's not The Humongous from Mad Max: The Road Warrior.

You should try being extra tall. I'm 6'9" and I don't fit into the tiny spaces between seats in theatres, cinemas, buses, trains or aeroplanes - with the latter I have to pay extra for the seats with extra leg room (near the exits). I just end up trying to avoid such places. I'm certain I would have the same problem as the man in the article - when there are fixed seats I simply can't get into them.

Officially (medically, though perhaps not legally) I'm classed as a 'giant' (which is awesome!) so perhaps that's a disability and I can sue?!

Oh, dear. Sorry, but no. As a former fatty myself, I sympathize with this guy, but he is most certainly not "disabled": he is overweight and needs fewer trips to WC, not bigger seats. Shame on him for trying to capitalize on laws designed to help truly disabled people just because he cannot control his appetite.
